Limited Warranty

1. Side Panels will not chalk lower than rating of 8 for a period of 20 years from the date the Side Panels are installed. Other Panels will not chalk lower than a rating of 6 for 25 years form the date the Other Panels are installed. Chalking ratings and testing will be determined by the procedures described as ASTM D659, current as of effective date of this Limited Warranty, or as it may be modified from time to time.
2. Side Panels will not crack, peel, or chip for a period of 25 years from the date of installation. Other Panels will not crack, peel, or chip for a period of 20 years from the date of installation. See definition of crack, peel, or chip in the definitions section of this Limited Warranty.
3. Side Panels will not fade greater than 5 units for a period of 20 years from the date of installation or greater than 7 units for a period of 25 years from the date of installation. Other Panels will not Fade greater than 6 units for a period of 20 years from the date of installation. Color measurements are to be made pursuant to ASTM D2244-85, current as of the effective date of this Limited Warranty, or as it may be modified from time to time, and only on clean surfaces after removing deposits and chalk pursuant to ASTM D3964(85).

Definitions:
Chip: small areas of surface paint failure evidenced by the coating not adhering, but not caused by physical
damage such as would be caused by banging or nicking.
Crack: a break in the flat coated surface visible to the naked eye resulting from exposure, rather than metal
forming or fabrication and which may be removed by taping.
Other Panel: a RYERSTAR panel installed to a designed application with an incline of greater than 15° - 75°.
Peel: coating which is pulling or falling away from the substrate due to failure of the coating as opposed to other causes.
Side Panel: a RYERSTAR panel installed to a designed application with an incline of 9° - 15°.

DISTANCE FROM SALT WATER

* The standard warranty terms stated in this Limited Warranty do not apply to applications in an environment which is closer than 2000 meters to salt water. The warranty term for applications closer than 2000 meters to salt water are subject to the terms and durations set forth in the chart immediately above.

Remedies:
In the event that RYERSTAR fails to perform in accordance with the warranty, Seller will either repair or replace on site, any such failure, or, at Seller’s option, otherwise restore such panels.

Limitations:
This Limited Warranty applies only to RYERSTAR panels installed in the United States and Canada and exposed to normal weather and atmospheric conditions. This Limited Warranty covers only those products described herein for the defects or failure expressly stated, and no other products or defects or failures. Without limitation, this Limited Warranty does not apply to defects caused by act of God, falling objects, harmful gasses or fumes, external sources, salt, atmosphere, chemicals and abnormal quantities of sand or dirt in the air. RYERSTAR panels are not warranted to weather uniformly under nonuniform conditions of exposure or use.

This Limited Warranty expressly exclusive coverage for defects or failure caused by: (i) handling, shipping, transit, processing after delivery, storage or installation; (ii) moisture or other contamination of the RYERSTAR panels prior to installation; (iii) improper application of the RYERSTAR panels, or (iv) the failure to provide proper drainage so as not to hold water.

SELLER MAKES NO WARRANTY, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION,
WARRANTIES OF FITNESS FOR ANY PURPOSE AND MERCHANTABILITY AND SHALL HAVE NO LIABILITY
WITH RESPECT THERETO EXCEPT AS SPECIFICALLY SET FORTH HEREIN.

Procedure:
If there is a failure which the Customer believes is covered by this Limited Warranty, the Customer must notify Seller in writing no later than thirty (30) days from the date of such failure is first detected. Such notice shall describe the failure with specificity and shall be delivered to Seller at its office located at 9040 North Burgard, Portland, Oregon 97208. Seller shall have a reasonable opportunity to inspect the panels identified as being defective. If a failure is covered by this warranty has occurred, the Customer shall be responsible to obtain and submit to Seller two or more competitive bids for repairing, replacing, or otherwise restoring the failed panels. Panels which have been repainted or restored in accordance with this Limited Warranty shall be covered by this Limited Warranty to the same extent and for the extent and for the same duration as the material repainted, replaced, or restored. Customer may cause the remedial work to be completed only after Customer has received written notice from Seller accepting one of the bids and authorizing Customer to perform such work. When Customer has provided satisfactory proof of its expenses Seller will pay such expenses to Customer in full and complete settlement of Customer’s claim. Seller has the right to reject any bids submitted by Customer and in such case, Seller will cause the appropriate remedy to be performed, provided that the Customer cooperates with Seller.

IN NO EVENT SHALL SELLER BE LIABLE FOR ANY SPECIAL CONSEQUENTIAL OR INDIRECT DAMAGES
WITH RESPECT TO THE PANELS. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF
INCIDENTAL OR CONSEQUENTIAL DAMAGES FOR CONSUMER PRODUCTS SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS WHICH MAY VARY FROM STATE TO STATE.

Miscellaneous:
This warranty is between Seller and Customer only. The warranty may not be transferred or assigned, in whole or in part, to any other party. This warranty shall become effective only when returned completely filled out and signed by Customer and all bills of materials or invoices relating to covered materials have been paid in full.
